Twinmo provides cloud-based software products for physical product testing, validation, and testoperations management, including access to the TestRuns platform and related softwarefeatures.
The Product is provided on a software-as-a-service (SaaS) basis and accessed electronically.
Subject to payment of applicable fees, Twinmo grants you a limited, non-exclusive,non-transferable, non-sublicensable license to access and use the Product for your internalbusiness purposes during the subscription term.
The Product is licensed, not sold.
No refunds are provided for unused subscription time except as required by law or expresslystated in this Agreement.
Twinmo does not process or store payment card data.
Refunds may be refused where permitted by law if there is evidence of fraud, abuse, orsubstantial prior use of the Product.
Twinmo’s offering through Paddle is limited to software access only.

For customers located in India, Twinmo does not sell, provide, or bundle anyhuman-delivered services through Paddle, including but not limited to:
Indian customers purchase only access to the digital software Product.
This limitation exists to allow Twinmo to provide software access in India without requiring alocal subsidiary or physical presence, while ensuring compliance with applicable laws.
In regions outside India, Twinmo may offer additional services under separate writtenagreements (such as a Master Services Agreement).Such services are not part of this Agreement and are not sold via Paddle.

Twinmo processes data in accordance with its Privacy Policy and applicable data protectionlaws. You are responsible for maintaining appropriate backups of your data.
The Product is provided “as is” and “as available.”
Twinmo does not warrant uninterrupted availability, error-free operation, or fitness for aparticular regulatory or compliance purpose.

This Agreement is governed by the laws of the State of Delaware, USA, excludingconflict-of-law principles.
